What Happens After an Interview Under Caution?

An interview under caution can be a stressful experience, and many people are left uncertain about what happens once it has finished. No Further Action

One possible outcome is that the police decide to take no further action. This means the investigation has concluded and you will not be charged. If no further action is taken, the matter is closed.

Release Under Investigation or On Bail

If the police are not in a position to make a final decision, you may be released while enquiries continue. This can be either under investigation or on bail. Being released under investigation means there are no bail conditions, but the investigation remains ongoing. Being released on bail means you may have to comply with specific conditions and may be required to return to the police station at a later date.

Both situations can last for a significant period, particularly in complex cases. It is important not to assume that silence from the police means the case has been dropped.

Being Charged

Another possible outcome is that you are charged with an offence. This may happen immediately after the interview or at a later date once the police and Crown Prosecution Service have reviewed the evidence. If you are charged, you will be given details of the allegation and informed of the next court date. Legal advice at this stage is essential.

In many cases, the police will refer the file to the Crown Prosecution Service for a charging decision. The CPS will consider whether there is sufficient evidence to provide a realistic prospect of conviction and whether a prosecution is in the public interest. This process can take time, and delays are common.

Even after an interview under caution has ended, you continue to have the right to legal representation. You should not discuss the case with anyone other than your solicitor. Anything you say to others could be passed to the police or relied upon as evidence later.
